Le problème du sujet ou de l'intersubjectivité représente, sans aucun doute, une des questions les plus importantes de la philosophie politique et juridique contemporaine. C'est ce que confirme le retour de l'éthique dans nos sociétés démocratiques ainsi que les remises en question de tout concept de subjectivité. Ces dernières pourraient bien servir de fil conducteur à une reconstruction de l'histoire des différents projets modernes de la philosophie. A cette possibilité de reconstruction s'ajouteraient non seulement les différentes tentatives de repenser l'intersubjectivité (...) telles que les ont menées des penseurs comme Husserl, mais encore ses déconstructions opérées par Nietzsche, Heidegger et le heideggerianisme français d'une part, ainsi que les reconstructions entreprises au sein de l'éthique de la discussion (Karl-Otto Apel et Jürgen Habermas). Même le débat, devenu emblématique, de la philosophie politique et juridique anglo-américaine entre libéraux et communautariens tourne autour de la notion de subjectivité. Les théories féministes contemporaines réussiront, elles aussi, à la raviver, à la polariser autour de deux éléments sexuellement différents : le "sujet mâle de la raison" et le "sujet féminin essentiellement caractérisé par la tendance à la sollicitude"? Les théories féministes n'ont-elles pas repris à leur compte le slogan de la fin de l'homme, l'une des plus importantes déclarations de guerre des déconstructions postmodernes de la métaphysique occidentale, notamment des théories modernes? N'ont-elles pas trouvé dans cette déclaration un écho favorable à leur cause, dès lors que l'homme s'identifie au "sujet mâle de la raison", propriétaire chrétien et blanc"? L'importance des problèmes soulevés par le concept de la subjectivité, sa place dans la philosophie contemporaine sans parler des controverses qu'il génère expliquent et imposent ce nouvel investissement auquel nous consentons. L’objet de la présente contribution est d’examiner les relations qu’établissent plusieurs auteurs entre l’amélioration de l’homme, la nature humaine et l’humanisme. Après avoir défini un sens faible et un sens fort du transhumanisme, nous y avons opposé deux critiques, celle de J. Habermas et de M. Sandel, en prenant l’exemple le plus discuté dans la littérature : la possibilité d’améliorer génétiquement son enfant et avons montré qu’elles ne sont pas convaincantes : le recours au concept de la nature humaine à (...) lui seul n’aide pas à répondre à la question de savoir si l’amélioration génétique d’un enfant est morale ou non. Il en est de même de la caractérisation de l’amélioration de l’homme en terme d’humanisme. Loin d’être une justification, il peut aussi s’appliquer à toute position dite bioconservatrice : le transhumanisme peut être humaniste dans le sens heideggérien critique de la technique comme métaphysique. The key to action control is one’s ability to adequately predict the consequences of one’s actions. Predictive processing theories assume that forward models enable rapid “preplay” to assess the match between predicted and intended action effects. Here we propose the novel hypothesis that “reading” another’s action intentions requires a rich forward model of that agent’s action. Such a forward model can be obtained and enriched through learning by either practice or simulation. Based on this notion, we ran a series of (...) studies on soccer goalkeepers and novices, who predicted the intended direction of penalties being kicked at them in a computerized penalty-reading task. In line with hypotheses, extensive practice in penalty kicking improved performance in penalty reading among goalkeepers who had extensive prior experience in penalty blocking but not in penalty kicking. A robust benefit in penalty reading did not result from practice in kinesthetic motor imagery of penalty kicking in novice participants. To test whether goalkeepers actually use such penalty-kicking imagery in penalty reading, we trained a machine-learning classifier on multivariate fMRI activity patterns to distinguish motor-imagery-related from attention-related strategies during a penalty-imagery training task. We then applied that classifier to fMRI data related to a separate penalty-reading task and showed that 2/3 of all correctly read penalty kicks were classified as engaging the motor-imagery circuit rather than merely the attention circuit. This study provides initial evidence that, in order to read our opponent’s action intention, it helps to observe their action kinematics, and use our own forward model to predict the sensory consequences of “our” penalty kick if we were to produce these action kinematics ourselves. In sum, it takes practice as a penalty kicker to become a penalty killer. (shrink)

Fowers et al. recently made a general argument for virtues as the characteristics necessary for individuals to flourish, given inherent human limitations. For example, people can flourish by developing the virtue of friendship as they navigate the inherent human dependency on others. This general argument also illuminates a pathway to flourishing during the COVID-19 pandemic, the risks of which have induced powerful fears, exacerbated injustices, and rendered life and death decisions far more common. Contexts of risk and fear call for (...) the virtue of courage. Courage has emerged more powerfully as a central virtue among medical personnel, first responders, and essential workers. Longstanding inequalities have been highlighted during the pandemic, calling for the virtue of justice. When important personal and public health decisions must be made, the central virtue of practical wisdom comes to the fore. Wise decisions and actions incorporate the recognition of relevant moral concerns and aims, as well as responding in fitting and practical ways to the specifics of the situation. Practicing courage, justice, and practical wisdom illuminates a path to flourishing, even in a pandemic. (shrink)

This volume re-examines some of the major themes at the intersection of traditional and contemporary metaphysics. The book uses as a point of departure Francisco Suárez’s _Metaphysical Disputations_ published in 1597. Minimalist metaphysics in empiricist/pragmatist clothing have today become mainstream in analytic philosophy. Independently of this development, the progress of scholarship in ancient and medieval philosophy makes clear that traditional forms of metaphysics have affinities with some of the streams in contemporary analytic metaphysics. Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

Pojem filosofie nabyl v průběhu historie řadu podob a významů. Kromě tradičního teoretického zaměření se lze setkat s přístupem, který vyzdvihuje praktický dopad filosofování na život člověka. Příspěvek představuje koncept filosofické praxe a reflektuje její současný stav na území České republiky. Autoři vymezují filosofickou praxi jako disciplínu filosofie, a načrtávají její možné dělení na dílčí oblasti. Nastíněny jsou její historické kořeny, které autoři identifikují v antickém Řecku. Dále se věnují systematickému představení doposud sepsaných materiálů k filosofické praxi a přehledu její (...) realizace na území České republiky. Detailní pozornost věnují autoři popisu tří jejích oblastí, mezi které patří filosofie pro děti, filosofický workshop a filosofická konzultace. Kromě teoretického vymezení reflektují rovněž své vlastní postupy v uvedených oblastech. Článek čerpá především ze zahraniční odborné literatury, konkrétně z textů a dalších materiálů filosofických praktikantů. Jeho cílem je představit českému čtenáři doposud podrobněji neřešený koncept filosofické praxe a připravit tak pole pro možnou debatu na akademické rovině. -------- The concept of philosophy has had several forms and meanings throughout the history. Besides the traditional theoretical focus, we may also encounter the approach that highlights a practical impact of philosophizing on one’s life. This text introduces the concept of philosophical practice and reflects its current situation in the Czech Republic. Authors characterize philosophical practice as a discipline of philosophy and present its possible division into subsections. They also present its historical roots, which can be found in ancient Greece. Moreover, authors introduce available sources dealing with the philosophical practice and describe how this discipline is actually practiced in the Czech Republic. Detailed attention is given to three of its sections, namely philosophy for children (P4C), philosophical workshop, and philosophical consultation. Authors present theoretical background and also reflect their own methods in these sections. The text draws primarily from scholarly literature from abroad, particularly from the manuscripts and other sources produced by philosophical practitioners. The aim of this text is to introduce the concept of philosophical practice to the Czech reader and prepare the field for further academic discussion. (shrink)

Příspěvek se věnuje problematice antického řeckého sportu, konkrétně významu sportovních zápolení a jejich výchovné a vzdělávací roli. Pozornost autor věnuje rozboru pozic filosofů Sókrata, Platóna a Aristotela. Po nastínění kontextu tématu představuje a interpretuje základní filosofické a náboženské premisy sportovního výkonu a jeho výchovné role. Řadí mezi ně úsilí o dosažení božské přízně, nesmrtelnosti, vyššího společenského postavení, ale i ideálů kalokagathia, areté a dalších ctností. Důležitý rozměr antického sportu spatřuje rovněž v jeho formativním potenciálu směřujícímu k přípravě na duševní život. (...) Hlavní část příspěvku se věnuje přístupu k pohybovým zápolením u filosofů Sókrata, Platóna a Aristotela, kteří svými úvahami k chápání výchovné role sportu podstatně přispěli. Následně se autor zaměřuje na identifikaci dobrého sportu podle zmíněných myslitelů a na zkoumání role sportu v kontextu dobrého života, který nahlíží v aristotelském rámci jako dosahování blaženosti. Cílem textu je identifikovat a vyzdvihnout výchovný smysl sportování, poukázat na jeho filosofické konotace a možnou roli sportu v otázce vedení dobrého života. ----------- This manuscript deals with the problematics of ancient Greek sport, specifically with the significance of sporting practices and their educational role. Attention is given to a detailed analysis of the positions of the philosophers Socrates, Plato, and Aristotle. After demonstrating the context, the author presents and interprets fundamental philosophical and religious premises of the athletic performance and its educational role. Among the identified features are the effort of acquiring divine favour, immortality, higher social status, but also the ideals of kalokagathia, areté, and other virtues. Important dimension of ancient Greek sport is also found in its formative potential which aims at the preparation for intellectual life. The main part of the article is focused on the approaches of the philosophers Socrates, Plato, and Aristotle towards the sporting practices. These thinkers made an important contribution to the understanding of the educational role of sport. Then, the author identifies a good sport according to these thinkers and examines the role of such sport in the context of a good life, which is considered in the Aristotelian perspective as achieving beatitude (eudaimonia). The aim of this article is to identify and highlight an educational purpose of sport, underlines its philosophical connotations, and demonstrate its possible role in the context of a good life. Autor v tomto článku rozporuje pojem non-agrese Murrayho N. Rothbarda a využívá při tom to, co nazývá paradoxem non-agresivní vraždy. Autorovou ambicí není nic menšího než rozbít základy Rothbardovy politické filosofie a využívá přitom důkaz sporem, tedy fakt, že vyvrácení kontradiktorního opaku jako nepravdivého je za podmínek úplné disjunkce zároveň důkazem pravdivosti dokazované teze. Dokazovanou tezí je zde teze: v určitých případech existují pozitivní práva a povinnosti, tedy práva a povinnosti nevyplývající ani ze smlouvy, ani z předešlé agrese. O této (...) skupině práv a povinností však Rothbard říká, že ve skutečnosti neexistuje. Důvodem dle Rothbarda je, že takováto pozitivní práva a povinnosti by porušovaly sebevlastnictví povinovaného, resp. jeho právo k vlastní osobě a majetku. Autor tohoto článku naopak jejich existenci dokazuje poukazem na nepravdivost kontradiktorního opaku („pozitivní práva nikdy neexistují“), kterou ukazuje na uvedených paradoxech obklíčitele, majitele člunu, hostitele a skokana. Určité konkrétní majetkové právo nemůže mít subjekt A i subjekt B současně a ve stejném rozsahu. Zatímco však Rothbard tvrdí, že majetkové právo může vyplývat pouze ze smlouvy či z předchozí agrese (jako právo na kompenzaci), autor tohoto článku argumentuje, že majetkové právo nemusí vyplývat pouze ze smlouvy či z předchozí agrese, a dokazuje to existencí případů, kdy popření mimo-smluvního majetkového práva implikuje paradox non-agresivní vraždy: subjekt, který naplánuje úkladnou vraždu, se nedopouští protiprávní agrese. Což je rozpor. Ergo, teze „pozitivní práva nikdy neexistují“ je nepravdivá. Ergo, pravdivá je autorem dokazovaná teze. Mimo-smluvní práva a povinnosti se tedy nachází v obsahu správně pojatého pojmu sebevlastnictví a úkladná vražda se nikdy nenachází v rozsahu správně pojatého pojmu non-agrese. (shrink)

V rámci filosofie věd panuje široká shoda na tom, že druhá polovina 20. století složila „labutí píseň" pozitivismu. Milton Friedman a Paul Samuelson, dva klíčoví autoři k metodologii ekonomie v daném časovém období, přitom tento vývoj ve filosofii vědy prý nikdy nereflektovali. Pozitivistická východiska - v prvé řadě v podobě redukcioni- stického přístupu - jsou tudíž stále přítomna ve vlivných teoretických konceptech rozvinutých ekonomy hlavního proudu. Značný počet autorů však v současnosti sdílí náhled, že tyto koncepty v nezanedbatelné míře přispěly (...) k vývoji, jenž ústil ve finanční krizi, vrcholící v letech 2008 a 2009. Předkládaný článek se proto táže, zda to byla právě krize - v níž mnozí spatřují empirické zamítnutí řady pozitivistických konceptů - která napsala „labutí píseň" pozitivismu v ekonomii hlavního proudu. V tejto kritickej stati sa zamýšľam nad poslednou knihou slovenského filozofa Mariána Zouhara Význam v kontexte (2011). Text je rozdelený na dve základné časti: opisnú, zameranú na expozíciu najdôležitejších momentov Zouharovho diela, a kritickú, v ktorej predkladám niekoľko pripomienok k autorovým záverom ohľadom kontextualizmu v sémantike.

En este artículo explico una parte de la labor de G. K. Chesterton como crítico económico: su crítica al sistema capitalista. Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. Desarrollo también cómo otros autores coinciden con Chesterton, con críticas parecidas. (shrink)

Sentences with disjunction in the scope of a universal quantifier, Every A is P or Q, tend to give rise to distributive inferences that each of the disjuncts holds of at least one individual in the domain of the quantifier, Some A is P & Some A is Q. These inferences are standardly derived as an entailment of the meaning of the sentence together with the scalar implicature that it is not the case that either disjunct holds of every individual (...) in the domain of the quantifier, \Every A is P &\Every A is Q. As we show, this derivation faces a challenge in that distributive inferences may obtain in the absence of plain negated inferences. We address this challenge by showing that on particular assumptions about alternatives, a derivation of distributive inferences as scalar implicatures can be maintained without in fact necessitating plain negated inferences. These assumptions accord naturally with the grammatical approach to scalar implicatures. We also present experimental data that suggest that plain negated inferences are not only unnecessary for deriving distributive inferences, but might in fact be unavailable. (shrink)

Ethical statements and position papers on genome editing often refer to “the public” that should get involved, and a public discussion that should take place. It is not self-evident what this reference to the public means and why such a public engagement should take place. This chapter explores the concept of the public as discussed in key position papers on genome editing and puts it into relationship with the notion of the public in political theory. The fuzzy notion of the (...) public is presented in these statements on genome editing as a tool to solve problems and to allow for hitherto unheard points of view to be considered. It is sometimes understood as a general tool for reciprocal education and social self-determination. Other times still it is used in an instrumental way to gain public support and foster an environment friendly to research and innovation. There is disagreement about the aims, the reason, and the norms guiding public discussion and the possibility of a neutral form of communication. Last but not least awareness is required for the way the public debate is framed by the very use of “genome” and “editing” rather than other concepts. (shrink)

In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. Second, we introduce and discuss two potential accounts of (...) the success conditions of normative models. Our tentative conclusion is that the second account is more promising. (shrink)

Linguistic theories often suffer from the dilemma that their explanatory power is based on extra-linguistic assumptions. The book delineates the essence of linguistic theory and linguistic explanation and, in doing so, proposes a solution to the dilemma. Simultaneously, the book is one of the first attempts to profile the philosophy of linguistics as a distinct sub-discipline of the contemporary philosophy of science.

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. Afterward, I address two pressing challenges against preference purification that emerge under the structural rationality account. (shrink)

The idea that particular legal institutions are artifacts is not new. However, the idea that the “law” or “legal system” is itself an artifact has seldom been directly put forward, due perhaps to the ambiguities surrounding philosophical inquiries into law. Nevertheless, such an idea has recently been invoked more often, though not always developed in detail in terms of what the characterization of the “law” or “legal system” as an artifact entails ontologically, and what consequences, if any, this has for (...) philosophical accounts of law. As a result, the primary aim of this paper is to attempt an inquiry into what the claim that “law” by its nature or character is an artifact entails, and what an artifact theory of law might look like.
